These Terms of Service ("Terms") govern your use of the Hushwake website and your purchase of products from it. By using the website or placing an order you agree to these Terms. If you do not agree, please do not use the website.

1. Who can order

You must be at least 18 years old, or the age of majority where you live, to place an order. By ordering you confirm that the information you provide is accurate and that you are authorised to use the payment method.

2. Products

Hushwake is a silent, vibrating wrist alarm designed to wake you without waking others. It is a consumer electronics product, not a medical device, and it does not diagnose, treat or prevent any condition. Product images are illustrative. We make reasonable efforts to describe products accurately, but minor differences in colour or finish may occur. We may change or discontinue products at any time.

3. Prices and payment

Prices are shown in the currency selected on the website and include VAT where applicable. Shipping costs, if any, are shown at checkout before you pay. Bundle discounts are applied automatically in the cart. For deliveries outside the European Union, import duties and taxes may be charged by your country and are your responsibility unless stated otherwise at checkout. We accept the payment methods shown at checkout. Payment is taken when you place the order. We may cancel an order if payment fails, if the price was displayed incorrectly due to an obvious error, or if we suspect fraud. If we cancel, we refund any amount already paid.

4. Order confirmation and contract

After you place an order you receive an email confirming that we received it. The contract of sale is concluded when we send the shipping confirmation. We can decline an order for any lawful reason, for example if the product is out of stock.

5. Shipping and delivery

Shipping times, costs and the countries we ship to are described in our Shipping Policy. Delivery times are estimates. Risk of loss passes to you when the parcel is delivered to you, or, for business customers, when it is handed to the carrier.

6. Right of withdrawal (EU, EEA and UK consumers)

If you are a consumer in the EU, EEA or UK you may withdraw from the contract within 14 days of receiving the goods without giving any reason. Tell us by email within that period, then return the goods within 14 days of telling us. We refund the price and the standard delivery cost within 14 days of receiving the goods back or proof of return. You pay the cost of returning the goods. You are liable for any reduction in value caused by handling beyond what is needed to check the nature and functioning of the product. Details and the model withdrawal form are in our Refund Policy.

7. Hushwake guarantee

In addition to your legal rights, every Hushwake band comes with our 30-night money-back guarantee and a 12-month warranty, described in the Refund Policy. EU consumers also have a two-year legal guarantee of conformity, which these Terms do not limit.

8. Warranty and liability

We are liable for defects in accordance with applicable consumer law. Our warranty does not cover damage caused by accidents, misuse, unauthorised modification, water damage beyond the stated rating, or normal wear of the strap. To the extent permitted by law, we are not liable for indirect or consequential losses, including missed appointments or lost earnings resulting from an alarm not being noticed. Nothing in these Terms limits liability for death or personal injury caused by negligence, for fraud, or for any liability that cannot be excluded by law.

9. Intellectual property

The Hushwake name, logo, product design, photos, text and website are our property or used under licence. You may not copy or use them commercially without our written permission.

10. Reviews and user content

If you submit a review, photo or other content, you grant us a non-exclusive, royalty-free licence to use it on our website and marketing. Content must be your own, truthful, and not offensive or unlawful. We may remove content at our discretion.

How we handle personal information is described in our Privacy Policy.

12. Governing law and disputes

These Terms are governed by the law of the Republic of Slovenia. If you are a consumer, you also keep the protection of the mandatory consumer laws of the country where you live. Consumers in the EU can use the European Commission's online dispute resolution platform at ec.europa.eu/consumers/odr. We do not participate in out-of-court dispute resolution before a consumer arbitration body unless required by law. Any court proceedings take place in Slovenia, unless mandatory consumer law gives you the right to sue where you live.

13. Changes to these Terms

We may update these Terms. The version published on the website at the time you place an order applies to that order.
